It has been and still is a crime. I think the authors point is that waterboarding has long been taught to be a crime in the military, but the current administration seems to think there is some legal gray area here because the practice doesn't damage organs or something. And you get a potential Attorney General that is unwilling to directly answer a question about the practice when asked by the U.S. Congress.
