Still missing the point.. when he comes home to his **** on the streer he needs on lawyer. The cops will tell you to let him back in or you will face arrest. He can also claim a bunch of his **** is missing. It does not require a lawyer.
He is a douche, no doubt about it and has refined the are of being a douche.

I'd file the 30-day notice and demand payment. Yeah, it's a crappy situation, but if the guy is still squatting 30 days from now it will be oh so satisfying to watch the cops remove him from the premises.
Don't give up on the money. Do whatever you have to to get a judgment against him. Someday he'll pay it.

the point is - the cops and courts aren't going to solve this situation. This will certainly end in vandalism and self-help. Guaranteed.

What I don't get is: How does he prove to the cops that he lives there? It's not on his ID or any other documents, he has no signed lease, etc.
Can I just call the cops and get access to any house I want just by saying "HEY I live here!"

that would be excellent.
Cop: This dude says he lives here and you moved all his **** out into the street. Wanna tell me what's going on?
shmooth: Officer - I have never seen that man before. He set up all this stuff here on the curb about an hour before he called you and frankly I am scared to death he is some kind of raving lunatic trying to steal my house.
Deadbeat roommate: "Don't tase me bro! DOn't tase me....ZZZZAAAAPPPPPPP!....YeeeeOuch! arrgh, gurgle, twitch......."
shmooth: Thank you officer, guardian of peace, justice, and the American way.
Cop: No problem citizen - glad to help.

- Ask neighbors - If the guy has been coming in & out of the house then maybe they'd notice
- Possessions strewn on the lawn - They came from somewhere, maybe the house that he was living in?
- Possessions in the house - Why would they be there if he wasn't living there? Of course I'm talking about furniture and furnishings, as opposed to a toothpaste & a t-shirt

Get the 30 day for ****s and giggles.
Then get a new roomate to share his bed, some really annoying SOB. Say they have to share space. Or better yet, pretend you're about to paint your room and say he has to sleep on the floor because you have to sleep there.
I agree that creating a confrontation where he can call the cops and his junk is all over the street is a bad move. Cops are lazy and the easiest thing for them to do is force you to let him back.
So it sounds like get the 30 day, and just totally screw the guy for the time he stays there. Loud music when he's sleeping, etc. Eat his food. Punch him in the face as he comes and goes.

Umm.....You don't put his stuff on the lawn, you haul it somewhere else.

1- Okay.
2- Don't dump the crap on your own property.
3- How does he prove that a single shirt button in the house is his? Does he carry receipts around?

THEN you may be able to just straight up boot him, but when the cops come and see all of his stuff there they will say "he IS living here" however he is guilty of a crime in that case... not changing his address with the sec. of state. He will then probably be asked to choose if he lives there and take the ticket or if he does not live there and be told to leave?
Him not having the address on his ID could certainly help.

Atty/Judge: "Sir, where have you been living the past 3 months?"
Deadbeat: "Smooth's place".
That's pretty much how it would go.

Yep.
But to follow your point: If he has ZERO documentation, he just says "I live there." ??
So Joe the can-man can just throw his junk on my lawn and then call the cops and say "I live in there." and take me to court and tell the judge "I live there." and then I have to live with the guy for 30 days while I evict him?

The cops will then ask him about things about what is in the house, etc. in an attempt to determine if he actually lives there or not. If you get caught lying, you could be in some trouble.
I am telling you, many years ago, I had to get rid of a fungal beotch the hard way. I actually hid almost everything she owned in the bathtub stall while she was gone, changed 4 locks an dtold her I sent her stuff with her friend. She shows up trying to get in, I tell her her friend has her stuff (which I WAS bringing to her that night) she calls cops, cops show up and luckily I know the guy. I am like "she doesn't live here, lets go through all of my stuff and see if ANY of it looks like it is from a girl. He goes through every drawer, closet, storage bin in the place but does not look in the bathroom and tells her to leave.
I gave her friend her stuff that night. If the cop had found anything she described he told me 30 day is the only way to get rid of her... or a PPO.

Then here's the advice to Shmooth. Punch yourself in the eye and get a PPO...
I now have a release form for all my houseguests stating that they do not live with nor have they ever lived with me........
By the way, did the fungal girl get into trouble for "lying" about living with you?

By definition she "lived" there (stayed the night) for less than a month but she did it by slowly leaving things there, not by any sort of agreement, but I did let her have a key... The cop was my friend and because she was causing a **** storm yelling and bitching in the parking lot he did threaten her with a disorderly on the spot and a trespassing if she returned.

Party time! Situation has been resolved. The lowlife ****er has cleared out. I was rather looking forward to the move out party me and a bunch of friends were going to have today, but it still all worked out nicely.
Happy Labor Day to all; and happy birthday to Sparky, welcome to the grown man club.
Now, as for this ****in toolbox...

Let me know if you want to head to the party. I had to swing by my house and now my couch grabbed me.
